Please carefully read the following. By registering for this 9/11 Day event (the "Service Project"), as a volunteer you acknowledge and agree to our waiver and release described herein, and release MyGoodDeed (d.b.a "9/11 Day") and all other suppliers and partners, and each of their respective subsidiaries and affiliates (collectively the "9/11 Day Parties") from any and all liability whatsoever in connection with the Service Project.
 

Liability Waiver:
In consideration for being permitted to participate as a volunteer in the Service Project being organized in observance of 9/11 under the management of MyGoodDeed (d.b.a. “9/11 Day”), you acknowledge that your participation in the Service Project may subject you and your family to risk of injury, sickness or death, and you hereby release and hold harmless the 9/11 Day Parties from any and all liability for any injury, sickness or death, or damage or loss of property, that may occur before, during, or after your service, related in any way to your participation in the Service Project, to the greatest extent permitted by applicable law.
 

COVID-19 Waiver:
At 9/11 Day, we remain committed to creating and running Meal Pack events that prioritize the health and safety of all volunteers and participants while also honoring the spirit of service and kindness that arose in the aftermath of the September 11th attacks. Please be aware that this is a public activity that involves and requires relatively close contact with others during the time you are participating in the Service Project. While we have established these guidelines to help reduce the risk of you and other participants coming into contact with others who may be COVID-19 positive, and possibly contracting the COVID-19 virus, we cannot guarantee that these steps will prevent participants from being exposed to or contracting COVID-19 at the Service Project. Accordingly, all participants are strongly encouraged to wear masks at all times during the Service Project and to be fully vaccinated. Masks should be worn correctly, with mouth and nose fully covered, at all times. Masks will be provided for any who need them, though participants may bring and wear their own masks if preferred.

In light of the ongoing spread of COVID-19, individuals who fall within the following categories should not engage in the Service Project:

(1) individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others; and/or,  

(2) Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment, and /or;

(3) Individuals who are experiencing symptoms of any illness, including cough, congestion, or other symptoms of illnesses that may be passed on to others, or subject themselves to other illnesses.

Participation in the Service Project is voluntary. By registering for, and participating in the Service Project, participants acknowledge the foregoing and assume, to the greatest extent permitted by applicable law, all risk for contracting COVID-19 and related injury, illness or death, and you agree not to hold the 9/11 Day Parties responsible. Anyone with concerns regarding their health, safety or well being should not participate in the Service Project.
 

Media Release:
For consideration, the receipt and sufficiency of which is hereby acknowledged, you irrevocably authorize the 9/11 Day Parties to copyright, use and publish for any lawful purpose the photographic images, audio recordings, video images, and other recordings of you that are collected during your participation in the Service Project (the “Materials”). You hereby waive any and all interest in or claims to any and all Materials and do hereby grant to the 9/11 Day Parties full permission for advertising and publication purposes, or any other legal purposes to copyright, use, sell, publish or license the Materials, and to make changes or alterations therein and/or additions thereto in connection with testimonial copy with fictitious names or otherwise and for any and all commercial purposes whatsoever.

You do hereby waive any right that you may have to inspect or approve the finished product or advertising or other copy that may be used in connection therewith or the use to which it may be applied and the 9/11 Day Parties may edit, modify or reuse the above in any manner for purposes of advertising and trade in any and all media, without limitation. You hereby release and fully discharge the 9/11 Day Parties, their successors and assigns and all persons acting under their permission or authority, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the recording, taking of, or in any processing of the Materials or tending toward the completion of the finished product.
 

Allergy Notification:
Recipes may contain soy, nuts and other food allergens. The 9/11 Day Parties do not guarantee an allergen-free environment.
 

Authorization:
You do hereby warrant that you are of full age (18 years of age or older), or you are the parent or guardian of the subject registering for the Service Project, and that you have every right to contract in your (or his/her) own name and further that you have read the above Authorization, Waiver and Release, prior to its execution, and that you are fully familiar with its contents and that you agree to be bound by its terms and conditions. Furthermore, if any provision or term of this Authorization, Waiver and Release is determined to be invalid, illegal, or unenforceable, it shall not affect the enforceability of any other provision. Rather, the invalid, illegal, or unenforceable provision or term shall be modified to the extent necessary so that it is valid, legal, and enforceable and to the fullest extent possible reflect the intention of the parties hereto.
